1. Agreement to Terms
By accessing or using the services provided by Arana's Painting, INC. ("Arana Painting," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.
2. Services
Arana Painting provides professional painting services including but not limited to:
- Residential interior and exterior painting
- Commercial painting services
- Kitchen cabinet painting and refinishing
- HOA and multi-unit property painting
- Deck and fence staining
- Color consultation services
All services are subject to availability and may vary based on location within our service area (San Mateo County and surrounding Bay Area communities).
3. Estimates and Pricing
Free Estimates: We provide free, no-obligation estimates for all painting projects. Estimates are valid for 30 days from the date of issue.
Pricing: Final pricing is based on the scope of work, materials required, surface conditions, and project complexity. Any changes to the original scope may result in adjusted pricing.
Additional Costs: Additional charges may apply for:
- Extensive surface preparation or repairs
- Premium or specialty paints
- Rush or after-hours work
- Changes requested after work has commenced
4. Payment Terms
Deposit: A deposit may be required before work begins, typically 25-50% of the total project cost.
Final Payment: The remaining balance is due upon completion and final walkthrough approval.
Payment Methods: We accept checks, credit cards, and electronic transfers.
Late Payments: Payments not received within 30 days of invoice may be subject to a late fee of 1.5% per month.
5. Scheduling and Access
Scheduling: Project start dates are scheduled based on mutual agreement. We will make every effort to meet agreed-upon timelines, though delays may occur due to weather, material availability, or unforeseen circumstances.
Access: Clients must provide reasonable access to the work area. Any delays caused by lack of access may result in schedule adjustments.
Preparation: Clients are responsible for removing or protecting personal belongings, furniture, and valuables from the work area unless otherwise agreed upon.
6. Warranty
Workmanship Warranty: We stand behind our work with a 2-year warranty on workmanship for residential projects and 1-year warranty for commercial projects.
Paint Manufacturer Warranty: Paint products carry their own manufacturer warranties, which we will help facilitate if issues arise.
Exclusions: Warranties do not cover:
- Normal wear and tear
- Damage caused by accidents, abuse, or negligence
- Issues arising from improper maintenance
- Structural defects or moisture problems not disclosed before work
- Color fading due to UV exposure (normal for exterior paint)
7. Licensing and Insurance
Arana Painting is a fully licensed and insured painting contractor:
- California Contractor License: #1015308
- General Liability Insurance: Comprehensive coverage for property damage and injuries
- Workers' Compensation: Full coverage for all employees
Copies of insurance certificates are available upon request.
8. Cancellation Policy
Before Work Begins: Cancellations made more than 48 hours before the scheduled start date will receive a full refund of any deposit.
Less Than 48 Hours Notice: Cancellations with less than 48 hours notice may forfeit up to 25% of the deposit to cover administrative and scheduling costs.
After Work Begins: If a project is cancelled after work has commenced, the client is responsible for payment of all work completed plus materials purchased.
9. Limitation of Liability
To the maximum extent permitted by law, Arana Painting's liability for any claims arising from our services shall be limited to the total amount paid for the specific service in question. We are not liable for:
- Indirect, incidental, or consequential damages
- Loss of use or business interruption
- Pre-existing conditions not disclosed before work
- Delays caused by circumstances beyond our control
10. Dispute Resolution
We are committed to customer satisfaction and will work to resolve any concerns directly. If disputes cannot be resolved informally, they shall be settled through binding arbitration in San Mateo County, California, in accordance with California law.
11. Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified terms.
